if someone who is emotionally unstable signs a waiver, can the waiver be illegitimate?

Emotionally unstable does not necessarily mean that the person does not have the capacity to enter into a legally binding contract. A waiver may be effective, unless the person fails to have the capacity to understand what it means. Without knowing more information, it is difficult to determine whether the waiver is effective or not. At a minimum we would need to know what you mean by "emotionally unstable" and we would have to review the language of the waiver and the circumstances under which the waiver was given.
