Legal Question in Criminal Law in Arizona

marijuana possession and paraphenilia

My fiancee and I were stopped in Puerco, AZ for speeding. We were on the road, driving to our new home in PA. When we were stopped the cop found two bongs, a pipe and less than an ounce of marijuana. We just got the papers charging us with felony counts (class 6) for possession of marijuana and paraphenilia. We are due to be in court this month but we have no way to fund a trip out there to make the court date as we have just moved cross country. What we want to know is, what are the consequences of not showing up? Can these charges follow us out here in our new state? We were never actually arrested, the officer just let us go after the search and seizure.

You will need representation in both AZ and PA. Our offices have a relationship with attorneys in AZ and can coordinate, but you should get in touch with counsel sooner rather than later.

Re: marijuana possession and paraphenilia

If you do not keep your court date a bench warrant will be issued for your arrest. It is possible, but questionable, whether or not AZ will extradite from PA for the amount of MJ you describe. But the warrant will go into the system and if you are stopped for a traffic violation or similar it may show up to haunt you. Call the prosecutor's office and see if they will reduce the charge to a misdemeanor [they often will] and if you can pay a fine and waive personal appearance so you don't have to return to AZ. They already have the evidence, so you have little to lose. Good luck.
