Legal Question in DUI Law in Arizona

Extreme D.U.I &Victims Rights

I was involved in a car accident with my brother. He went to jail for EXTREME DUI and the AZpolice never asked me for ID. Brother is suing the state and i live in MICH as i did when we had the mishap. Now the Prosecuting Atty. is sending me forms at my mothers. Do i have to reply to the court on this matter or can I ignore the whole situtation???? What trouble can my brother be looking at if i do choose to ignore this????

Re: Extreme D.U.I &Victims Rights

If you knew your brother was intoxicated at the time it is difficult to see how you could help him. His best help could be from you not being available to testify.

You have no obligation to communicate with anyone you don't want to if you are not under court order to do so. You have no obligation to communicate with the DA if you are not a complaining witness or if you, as you say, are not under the jurisdiction of an AZ court.

Doesn't your brother have a lawyer? Why not check with him/her?
