Legal Question in Elder Law in Arizona

Danger to self and others

My father is 83, chronic alcoholic, COPD, falls 3-4 times a month resulting in bodily injury and refuses help. Recently he fell and broke his arm and did not tell anyone for two days. I called all day and no answer so I went over to his apartment. He was sitting on the toilet because he could not get up and had an emergency call button right next to me. He sat on the toilet over night. This is not the first time either. How can I become his conserviter or guardian?

Re: Danger to self and others

You should take immediate action to file a petition for appointment as Guardian and Conservator of your father at the Maricopa County Superior Court, Probate Division. You can find instructions and court forms at the Self Service Center on the internet, go to www.maricopa.gov

Since your father is likely to fight your effort to protect him by gaining legal authority to make decisions for him, I strongly suggest that you get experienced legal counsel to help you with this.

Also, consider making a report to Adult Protective Services or the police to do a welfare check if you are not able to take immediate action. He is obviously in danger.
