back child support after adoption

I just wanted to find out that if my husband adopts my daughter can I still collect the back child support that her real father owes? Also her real father is giving problems right now, trying to get the adoption paperwork signed, if i had to take him to court, how much does something like that usually cost. Also if at the time we went to court, he was paying child support currently would that be harder for my husband to adopt my daughter?... Thanks so much for your time

Yes, you can collect the back child support.It sounds like your ex is not clear on how he wants to proceed. I would tell him that you are going to file a contempt action against him for the back child support,or, in the alternative, go ahead and file it and the bargain with him. You should consult with a local attorney. The costs will vary, depending on the financial circumstances of the parties.
