Legal Question in Family Law in Arizona

Dissolution of marriage - Acceptance & Waiver of service.

After filling a petition for dissolution of marriage (divorce) with children in Pima County, Arizona and with an acceptance and waiver of service filed, is it required for the petitioner to appear in court to finalize? I will be outside the country when the dissolution is finalize, Can it be done through the mail, through an Embassy or a consulate?

If the matter is proceeding by Agreement, then no Court appearances are required. Instead, you can proceed by "Consent Decree".

If you are proceeding, instead, by default, then most Courts would expect your appearance. You could, however, submit a Motion to permit your telephonic appearance at the Default Hearing, especially if you will also have an attorney present to present the necessary dcoments.
