Legal Question in Family Law in Arizona

Payment realtor fees dividing property

We bought a house together two years ago and are now separating; I am moving out. We agree to divide all money over what we owe in mortgage. He has chosen to ''buy me out'' but expects me to pay now 3% of appraised value for future realtor fees. This seems wrong. Please help.

Re: Payment realtor fees dividing property

The general rule is that future realtor fees are NOT considered in valuing a house UNLESS the spouse who is getting the house plans to sell the house in the very near future. Since this does not sound like the case in your situation, you should NOT agree to reduce your share of the equity payment from your husband.
