Legal Question in Family Law in Arizona

my wife is using drugs and committing adultry

I am inquiring thru my parents to find out what I can do. I am in currently prison for a crime that i didnt do...literally. I have been granted a new trial which will without a doubt free me. My wife is living with another man, and they smoke pot and she abuses prescription drugs. ''They' have told my son the boyfriend is daddy too. She wont let my parents see my son or bring my son to visit (I have seen him twice since July 2002). The reason is my mom told my son this boyfriend was NOT his daddy. I have prior convictions but they were 6 yrs ago. How likely will my custody rights be affected when I file for divorce and custody.

Re: my wife is using drugs and committing adultry

If you are in jail, and we convince a Judge that your wife is abusing drugs, the Court will most likely get CPS involved.

As far as long term custody rights, I guess it really depends on why you are in jail, and what kind of dad you were, and what kind of Dad you become once you are released.

There really is no way to answer the question by e'mail. I can explain the issues better by phone or in person. We offer free 1/2 hour consultations, in which I could discuss your matter in more detail directly with your parents, and they could then forward the information to you.

Please have your parents either call me directly to discuss the specifics of your case, or contact my assistant Audrey to schedule a free 1/2 hour consultation. I look forward to talking with them.
