Re: L2 to H1B status transfer

Unless you were previously in H-1B status, you are subject to the H-1B cap. New H-1B numbers become available October 1, 2009, but to be eligible you must file an H-1B petition on or about April 1, 2009. If selected, you would be able to start H-1B status on October 1, 2009. Of course, as an L-2 you are eligible for work authorization.

Responding to this inquiry in no way establishes an attorney client relationship; however, I look forward to exploring these issues with you further by way of telephone or in-person consultation.

If you are interested in a phone consultation, we charge $150 (which amount would be applied to our fixed fee for an H-1B petition).
