CC&rs

When we purchased our home we were given the CC&Rs. Now that the developer no longer own property there is a homeowners association but none of the CC&Rs are being enforced. What and how does an individual homeowner enforce the CC&rs?

Any member of the homeowner's association can bring a suit to enforce the CC&Rs, on behalf of the association. If you win, you can be reimbursed for the costs and legal fees incurred in bringing the action.

But first, you should bring the issue before the board of directors and demand that they take action to enforce the CC&Rs.
