my brother died intestate. howns his home outright. he has an adault disabled daughter cared for by the state. should I probate or would state take his estate?

You must probate your brother's estate in order to get a court order distributing the property to the person(s) with the right of inheritance. Depending upon the value of the home, the probate process may be very informal and is not costly. Your brother's estate is not liable for his disabled daughter, who appears to be a ward of the state at the present time.
