Legal Question in Wills and Trusts in Arizona

Residence in AZ but Will and Attorney/Executor in WA State.

When my will written in WA, I named long-time family attorney (who wrote the will) rather than other family member as executor due to expected hassle/danger by disowned child to beneficiaries. I now live in AZ. Do I need new will? New executor? If no change, what will happen? Who presents will for probate?

Re: Residence in AZ but Will and Attorney/Executor in WA State.

Thank you for your inquiry.

If your will was valid when executed in WA, it should still be valid under AZ law, however, since time has passed and your circmstances have changed, it would be a good idea to have the will reviewed and probably updated. You are permitted to have an out-of-state Personal Representative (executor), but that will likely result in the hiring of an AZ atty. to handle the probate. Please contact my office for a no-cost initial consultation regarding your estate. I can tell you whether your will should be revised, and we can discuss alternatives that may eliminate the probate entirely. I look forward to hearing from you.
