Transfer Title to Mobile Home

My father passed without a will. His only asset was a mobile home. I know someone who would like to purchase it. Is it necessary to file a probate?

Depending upon the value of the mobile home, being less than $50,000, you can file an affidavit in the probate division of superior court and the ownership of the home will go to his heirs. Then, the heirs can sell the home as they wish. In order for you to have legal title to the home, which is required before you can sell it to anyone, the ownership of the home has to pass to you or the heirs if there is more than one of you.

Check with the self service center of the superior court for instructions and forms regarding a small estate.
