Job not completed. Stop payment on check

I had a job done. I gave this person a check, he said he would be right back to finish the job. He didnt show so I immediately call my bank and had stop payment on the check.

I later got a call fom this business and they said we had a check to come back, I told him i put a stop payment on this check. He did not get information on the person who cashed it. He told us we were liable for it. This business is suing us for the amount of this check. During bank business hours is it the business fault for taking this check?

It sounds like the business took a third party check. IOW he signed the check to them and represented it was good money. IMHO, it is part of the cost of doing business. You do not owe the business, the giy does and if they cannot find him then tough snookies. If they sue you then you have a cause of action against them for malicious prosecution.
