Legal Question in Wills and Trusts in Arkansas

Can I contest father's estate?

My father has 4 children from 2 marriages. He only acknowledges one of my siblings. I am certain my youngest brother will receive all of the estate. Do I have any legal right to any of the estate? My father and mother divorced many years ago; mother received some child support for us 3 kids, but only for a few years. Both of my parents remarried. Father had another child with second wife, divorced her and remarried again (no children of this marriage); 3rd wife now has terminal cancer. Father lived in Montana until a few years ago, now I believe him to be living in Arkansas. He had a successful business he sold several years ago and has since started another business.

Thank you in advance.

Stacy

Re: Can I contest father's estate?

I will answer this question assuming that your father is actually in AR. First of all, did your stepfather ever adopt you? If so, you most likely do not have any right to any of the estate. If not, your father's will would determine where his estate would go. If he chooses not to give you anything, that is his right. However, if he doesn't mention in the will that he is leaving you out, it is possible that you may be able to receive something from his estate. If he has no will when he passes, and you have never been adopted by anyone else, and can prove you are his offspring, then, yes, most likely you would inherit a portion of his estate. I need more info to tell you exactly what your options are and what you should do to preserve such rights. Please contact me if I can be of help.
