should I count my losses

Please advise..

2 years ago I leant my then partner over �7000 on the agreement she paid me back this year, The money was to be paid into a joint account in Melbourne which was linked to my Barclays account here in the UK. She is now refusing to accept/pay for this money. The only proof I have is the money leaving my UK bank account to the joint account we had in Australia and emails saying she will pay me back in Jan 2007

The million-dollar question here must be where the contract was made and where your so-called friend is now living.

If the contract was made in the UK you will be able to bring a claim through the UK courts but if your friend is living in Australia, it will be necessary to obtain leave to serve out of the jurisdiction and there will also be probable enforcement difficulties once judgement has been obtained.
