Legal Question in Disability Law in California

Can they just push you out?

My husband was injured on the job, when he was release ''permanent and Stationary'' the employer said they do not have a job with ''his disability restrictions'' they actually do. The union is not fighting for him, what can he do? He just wants to go back to work , he has been there over 20 years.

Re: Can they just push you out?

They can and do illegal things like pushing you out all of the time. The employer is required to accommodate disabilities to allow your husband to work. Failure to do that is illegal. The employer is also required to "engage in a good faith interactive process" to allow the return to work to happen. If the employer is not taking him back, and not engaging in that process, the employer is forcing you to resort to the courts for compensation. Feel free to contact off-line if you want to send me further info. Good luck.
