California Vehicle Code Smog Check Requirements for Transfer of Title

I sold a vehicle about six months ago. The vehicle was a 2001 GMC Sierra with 108k mi on it. I did not get a smog check done on it before I sold it. It currently had a valid registration when I sold it.

The new owner is now calling me saying that the vehicle is failing the smog check and needs a new catalytic converter for $800. Am I liable for this because I did not get the smog check done within 90 days of selling the vehicle. The new owner is not related to me. The truck is more than four years old. I have not received any notifications from the DMV saying that transfer of title has not occurred because of any lack of smog check requirements. Thank you.

The transferring owner is liable for smog certification, regardless of any agreement to the contrary. Work it out.
