Legal Question in Bankruptcy in California

Acquiring another vehicle after chapter 13

I filed a chapter 13 a little over a year ago. Can i buy another car and assure the new lender that i can not later include this new loan in the chapter 13 i filed previously? They are concerned about this. I think that my attorney informed me of this but i can't locate it in the paperwork. Please let me know.

Anything that you agree to after filing is binding. You cannot add newly signed contracts.

Thank you for your posted inquiry.

If you in the Central District Bankruptcy Court (or are in Orange County, as your zip code states), the local rules prohibit you from incurring new debt without the express permission of the trustee while in a Chapter 13 plan.

I hope that this information helps, but if you have more questions, want more information, or feel that you need legal representation, please feel free to contact me directly at [email protected]. Best of luck, and Im happy to help you in any way that I can.
