My computer just ate my response so here goes again. This is probably a dischargable debt but you should have an attorney represent you in bankruptsy. It is fairly complicated and can become more so if this creditor tries to bluff you. Had you had a competent insurance agent you might not be in the pickle you find yourself. I have a truck I seldom drive insured as a third vehicle for almost nothing.

You may be able to qualify depending on your income. With the new bankruptcy laws it is hard and expensive but it often can be done. There are a lot of new issues to look at as well as what assets you have and whether they are protected which depends on whether you have been in CA for the last 2 years and, if not, where you lived the prior 6 months before that. The new laws are a field of mines for the unwary. I am a certified bankruptcy specialist with 28 years in practice in the Sacramento areaa. I will be glad to give you a free, no pressure appointment where we can look at your situation and you can get ACCURATE advice so you don't step on one of those mines. Contact my staff and they will be happy to set your appointment with me. I look forward to talking to you.
