Legal Question in Bankruptcy in California

''justice for decent people'' ?

I had an EX friend borrow 2500.00 with a promise to pay it back witin 2 months. It has now been 16 months this was a cash advance that I have paid intrest on during the 16 months. She has paid back 700.00 and now has left the state. I called again about payment and she called and left a message telling me to call her attorney not her that she is filing bankruptcy. I have not recieved anything telling me so. Would it do me any good to go file this in small claims court tomorrow before I recieve anything about her bankruptcy? I don't want to lose another 165.00 filing fee if her attorney responds with an answer that ''she is in the process of filing bankruptcy'' Would the court even set a date or not? I guess the Question would be am I just screwed?

A lot of people who owe money say they're filing bankruptcy. Not everyone follows through. You can file a small claims case in CA and, once you get a judgment, get a lawyer in the state to which she's moved try to collect. It might be worth it since the debt is sizable. Good luck!
