Legal Question in Bankruptcy in California

Time limit for Bankruptcy

My divorce attorney also agreed to do a bankruptcy for me. I filled out all the necessary paperwork in 2001. A year went by and I never heard anything. When I called, they said they were waiting for my filing fee of $200.00. I sent that and waited another year. I Called again and they had misplaced it. I resent another cashiers ck. etc. Here it is 2004 and there is one excuse after another IF I can manage to talk to someone. In the meantime,he turned my divorce over to another attorney and I lost everything in the divorce. After 23 yrs. of marriage, he got the house, furnishings etc.He made a lot of money and I was a stay at home Mom. I now know I made a poor choice in attorneys but I cannot afford to hire another one. How long can I go simply not paying my creditors, hoping a court date for my BK will finally come around? I feel like a criminal. Should bankruptcy take this long? Will the time span be a problem? My bankruptcy consists of 2 credit cards I was forced to use while living with my mother, right after the separation for survival. I thought the outcome of the divorce would give me some sort of financial settlement to help repay my debts but it didn't happen and it was becomming too difficult to pay these debts.

Re: Time limit for Bankruptcy

If you can't afford a bankruptcy attorney, then you should look into doing it yourself. It doesn't take me more than a couple of days to process the paperwork and get it filed.

if you are determined to go thru with your bankruptcy, and without an attorney's assistance, you may want to check online for "do it yourself" bankruptcy links. its a fairly straightforward process, but MUST be done properly to fully protect you. if not, you risk dire legal consequences. you may want to also consider very viable alternatives to bankruptcy, especially if your debt is primarily credit card debt. if you would like other affordable and viable legal options to bankruptcy here, contact us today with your request.

I can pretty much guarantee that your attorney did one of two things: 1) he did not file BK, or 2) he filed, forgot to tell you about it, and it was dismissed. If you feel like e-mailing me directly at [email protected] your name and address (and county), I'll try to help find out more for you at no cost. -Robert F. Cohen, Esq.
