You could refuse to answer, and risk not getting an offer. Only a few things are 'illegal' to ask, including pregnancy status and intention, AIDS status, sexual orientation, arrest without conviction records, etc. If you can prove what you allege, and are willing to pursue litigation over it if you are denied a job because of your refusal, then feel free to contact me.
