Legal Question in Business Law in California

I manage a small Hotel (Bed & Breakfast) in California. Are there any laws that would prevent our staff from getting a copy of an individual�s Driver's License upon check-in as we have experienced a chain of fraudulent activity associated with pre-paid Visa charge cards?

You just need to be careful what happens to the copies. You should have a document retention and destruction policy in place and a good shredder.

The other attorneys are right on point here. I recently stayed at a hotel that made a copy of my driver's license as part of the check-in process. As Mr. McCormick advises, have a good document retention-destruction policy in place beforehand. Consult with a good business attorney in your area for specific advice.

You have a right to ask for proof of ID, and to make a copy, as a condition of providing the service. The info must be maintained against disclosure.
