non refundable deposits

Hello,

I have a issue with a local busuness whom refuses to return my deposit of 100.00 dollars. This type of bussiness is a private business, that houses birthday partys, I am not able to keep the arrangements made, giving them 2wks notice..I did not sign a contract or recall even a verbal on non refundable birthday parties. Neither a sign is posted at the business. Please let me know my legal rights on getting my deposit from the place of business....thanks...

This is a classic case for small claims court. It is possible that by simply filing and serving your small claims complaint, the business owner may not wish to go through the cost and time investment of defending, and will offer to refund your money. If not, you can argue your case before a small claims court (i.e. no signed contract, no verbal contract, reasonable notice of cancellation). Good Luck.
