Legal Question in Business Law in California

Raising money for charity

I am in a group, ''Newcomers & Friends''. We were told it is illegal to raise money to give to charitable causes. We used to have a white elephant sale and give the proceeds to a chosen charity. Is this illegal?

No, it is not illegal. You will want to work with the charity and provide donors a receipt showing the 503(c) number for charity donations.

Re: Raising money for charity

Many cities do have a requirement for licensing to raise money for charities. That usually is involved with raising dollars in direct solicitation, not in selling goods, the proceeds of which you turn over to a charity. My estimate is no one will ever bother you, but if you represent your intention to turn the proceeds over to a charity, it would be best if you had information about the charity and its qualification as a charitable orgainization, whether under Internal Revenue ruling, or its qualification to raise money on a local level.
