if a boyfriend give money to his girlfriend for a home down payment can he sue her to get the money back

Anybody can sue anybody for anything. Winning requires proof. If you have proof, then consult with counsel and take legal action. Without proof, maybe the threat of lawsuit from an attorney will convince her to repay.
