Could a signed contractual agreement that does not guarantee payment until a certain thing happens, still be presently forced into court, if there are other signs that the other party is breaching the written agreement?

You are being extremely vague. It helps us to know details. But the answer is that you can sue for breach of contract if there is evidence of a breach.
