RE: Demand for Payment

Dear Ms Roman:

Please be advised that you owe me the sum of $5000.00 because My personal property was disposed of by you. All my clothing, Shoes, Purses, 2 quilts, doilies and nick knacks handmade by my Great Grandmother, Christmas ornaments that my family had collected for generations, 2 Chairs and a leaf to my dining set, Leather ridding gear for horse and motorcycle, My daughters baby pictures and family pictures.

This will be your only chance to settle this matter before I file suit against you in Small Claims Court. I am agreeable to a lump sum payment, or to a payment plan. Please contact me on or before July 10, 2011 for purposes of settling this matter. If I do not hear form you on or before July 10, 2011, I will file a lawsuit against you without further notice. It is in your best interest to settle this matter before a lawsuit is filed. If a judgement is obtained against you, it will negatively affect your ability to get credit, you will be ordered to pay court costs, and you will incur interest at a rate of 10% per annum.

Based on the foregoing, I expect payment in the amount of $5000.00 made payable to me, 1399 Sacramento Ave #2 West Sacramento, Ca 95605 no later than July 10, 2011. (I can be reached at the address below.) If you decide to ignore this demand for payment, I will further pursue all of its legal remedies without further notice to you. This letter serves as evidence that I have attempted to resolve this matter informally.

Sincerely,

Cynthia M Byrne

West Sacramento, CA 95605

End of Quote.

As I remember, on or about April 2006 Cynthia Byrne and Don Wilson moved from a rental property on 64th Ave Sacramento, Ca. Don Wilson and I were in a newly relationship at that time. I acted on a request from Don Wilson that it would be a good idea to disposed of abandoned garbage bags that were left on property. To release Don Wilson or liability from rental agreement and and property.

My question to you is, Am I liable and if this personal property as stated by Cynthia m Byrne was so important, why has she not made attempts to recover in the last 5 years.

Is there a "Statue of Limitation" on personal property recovery. Cynthia M Byrne is just trying to extort monies from me

If it was in fact garbage, you could have disposed of it. Especially if your then boyfriend suggested that you dispose of it. Where is this boyfriend now? Will he testify for you that it was garbage. You should also be able to be easily let out of this case, since there is a 3 year limit to fiel a lawsuit for damages for property. Or else it may be 2 years.
