Legal Question in Technology Law in California

Using another account to send threats

My sibling visited from out of state, while visiting he used Mother's computer to send several harrassing and threatening emails to me, one month after assaulting me physically. Did he break the law in using another person's email account to harrass and threaten me?

I was going to file assault charges, but chose not have him arrested or jailed, because he's my sibling and fact he lives under a different roof and out of state, and I am secured where I live.

Re: Using another account to send threats

Possibly, but use of mom's computer is little more significant than use of mom's phone or, for that matter, the pay phone at the corner drugstore. Focus on substance, not form.

If these threats affect life or limb, go after him in both criminal and civil arenas. But words are seldom actionable as assaults. You should be thinking about whether his actions fit the mold for harassment or stalking. More likely that you could get a restraining order than win a lawsuit for assault at this stage.
