mold on lumber for new home

Hi,

I'm in the process of purchasing a new home in San Diego. The home is currently under construction. In looking at the framed structure, I noticed that there was quite a bit of, what looked like mold, on the wood. I paid a mold inspection company to come in and take samples. There were no toxic spores found, but there were a number of species of mold found in the samples. While the spores aren't toxic, I do have alergies to mold and I'm concerned that if the wood is not treated or replaced, there is a potential for the mold to spread in the future. The mold has been brought to the attention of the builder. It is not clear if they will do anything. I'm not sure what their legal responsibility is regarding the mold and it's potential to spread. This is more properly addressed to an industrial hygienist rather than a lawyer. You will want to ask the hygienist whether encapsulated mold is a cause for concern, especially if the mold is not of a type that is suspected to cause allergies.
