Pool Delays and Mechanics Liens

WE are having a pool built and on the contract it was supposed to be completed in ''60 working days'' It has past that and it hasn't been done yet. We paid him a 10% down payment which exceeded $200 and he was frontloading the money (something we NOW become aware is illegal). I try to contact the contractor and he won't return my phone calls and is coincidentally never in the office when I call. I am also beginning to question his intentions on paying the subcontractors and I don't want them filing liens on my property. He signed a paper saying he'd finish the job in 10 days and it has been way past that. What should I do? Any advice would be appreciated. Thank you.
