Legal Question in Construction Law in California

Public Contract Code 10720

Public Contract Code 10720 states that the School trustees have to provide Accurate palns and specifications......

I would like to know how the court rules on this issue, what cases can be reviewed and how to get court opinions.

We are working a project with drawings that have full of error. I am trying to build in some protect for our firm.

Hopefully, an attorney will provide you with case citations. However, you will probably need to hire an attorney to counsel you on your project and review the specific issues in your case.

Neither West's Annotated Codes or WestLaw yielded any cases citing Public Contract Code 10720. That doesn't mean there are no reported appellate cases, but strongly suggests that any reliance upon this code provision by any party in an appealed case was pretty trivial.

Although I am not a specialist in public contract matters, I believe that a contractor receiving plans and specifications with obvious or easily-discovered errors is under a duty to report the errors at the earliest possible time and work diligently with the contracting authority to minimize possible consequential damages. Your first course of action is to communicate with the owner, then get specialized legal counsel to assist you in recovering any unavoidable damages.
