Legal Question in Construction Law in California

well pump repair

I own 1/3 of water well on my property.My neighbor owns 1/3 and is trustee for her mother giving her 2/3. The well pump needs to be repaired, she has no money for her 2/3s. The well contractor says he will put a lein on both propertys , even if I pay the full amount (yes I have the money) he will still put the lein on my property. Even if I put a lein on her property for her share of costs I' ll be dead (age 85) before she would ever sell her property. Is there a legal way to have the contractor do the repairs without puting the lein on my property.

The contractor has no legal right to lien the property unless you don't pay them. If you have the money, you can pay for the repairs and sue her for reimbursement. If you win, you can put a judgment lien on your neighbor's property. You might not collect, but your heirs might be able to.
