How do you get your money from an attorney that doesnt know what he is doing?

It's not always easy to answer a simple question. Sometimes you need to evaluate the consequences to see if it's a good idea to fire your lawyer.

If you just hired him on an hourly basis, and the attorney doesn't have any other interest in the matter, then you can just write him a letter and ask for it back. You may want to call him first to tell him to stop work so the billing stops.

If he does have some other interest in the matter, like a partial contingency fee in a lawsuit or collection matter, then you need to weigh the consequences. Upon termination, the lawyer may have a lien on the recoverable proceeds or be entitled to a reasonable fee for his services.

If the lawyer is working on a time sensitive matter, or there are impending deadlines, you may not have time to get the work done or hire another lawyer.

In any case, before you make any decision to fire your lawyer, you should pick up the phone and call him and express your concerns. Perhaps there's just a simple misunderstanding.

I get most of my money from attorneys who don't know what they're doing. The rest I get from clients.
