Legal Question in Consumer Law in California

Consumer Privacy

I would like to know if a collector or a lawyer on behalf of a lien holder has the right to give information such as being sued, court dates, to a third party such as a roommate or parent or other family member who answeres the phone at the primary phone number?

Also whe serveing a defendant with papers to go to court. for civil court do they have to serve it directly to the defendant or is it okay to give it to anybody at the address? even if the person is no longer living at the residence?

Re: Consumer Privacy

If this is a consumer debt, then the lawyer or collection should not be discussing this matter with anybody other than the debtor.

With respect to service of the lawsuit, direct personal service is preferred but not required. If the process server comes to your door a sufficient number of times, they can leave the lawsuit with any adult and then mail you a follow up copy.
