Filing Small Claims with out of state Company

After purchasing an item online from

a home improvement company in

Baltimore Md. we had to cancel the

order because they misled us with

regards to the time it would take to

complete the order. It's been over

three months since we canceled the

order and they have not credited us.

The only people we've been able to

talk with are sales reps. who say

they'll pass along the word. I've

tried to call the owner, email him,

and sent a letter priority US Mail, but

heard nothing back. If this goes to

small claims do I file here in

California, or where the business is in

Baltimore MD.?

You will have to file in Baltimore. You most likely cannot get jurisdiction in California small claims court over an out of state defendant.
