Legal Question in Consumer Law in California

I installed a security system and signed a 3 year contract. It also stated in the contract that it would automatically renew for a year on the anniversary if a 30 day request to cancel was not given. The anniversary was in November 2010, I had some issues with the company the end of November first of December. They were slow in correcting issues I had and the system was down for 2 weeks. I called them several times and did not get a response. They had also not posted some payments to my account and were charging a late fee. I sent them a letter about the 19th of December and they said as I had not opted out 30 days prior to the 3 year end I would have to pay for the whole year.

It this legal and how do I get them to release me for bad performance.

You don't. Bad performance that is not a total abandonment of the contract, does not let you out. If you have losses due to the bad performance, sue for them. That does not mean the whole contract goes away, however.
