Liability

Signed purchase agreement for new

boat. It is now over 9 months late in

delivery. It costs $108,000 and is

95% paid for. Can't afford to sue for

breach of contract. Do I assume any

liability if I publish the facts about the

company's lack of performance on

the ''owners' group'' website as a way

of applying pressure to get the boat

done? No editorials -- just the

contract provisions, dates, etc.

Not if you can prove what you post, but you may harm your chances of resolving this amicably and quickly. I suggest you have an attorney contact them. We cover both CA and FL and are experienced trial attorneys.

I don't understand why you say you "can't afford" to enforce your contract. Read The Contract. Does the contract provide for attorney fees to be awarded to the prevailing party? Can you afford to lose 95% of $108,000? What if you wait one day or one week too long to sue, and they go bankrupt? Will you be out all that money? Have you actually spoken to a California attorney about the costs of suing them, or are you just assuming you can't afford it?

Venting to some website isn't going to get your boat delivered. At best, it will tick them off, and at worst, it will get you sued.
