Legal Question in Consumer Law in California

Magazine company refuses refunds.

I buy magazine subscriptions for other people. They pay me 40-50% off the retail price and I place the order. I benefit because I can get a full refund when I cancel about a year later.

The plan was working fine. I read everything I could find online about the company and no where did they state that orders could not be placed for resale.

I had been receiving refunds for about 5 months (by cancelling the prior years' orders). Then, the company began refusing refunds claiming that the subscribers name and address must match up to the cc#. Well, it doesn't match. When I placed the order, I used my cc# and my customers name and address.

They accepted the money for the order using my cc# and my customer's name and addy. Can they legally deny the refund to the exact same cc#?

By the way, they have cancelled ALL of my orders (after accepting payment) and my customers are not happy. I'm waiting on approx $200k in refunds so I can honor my customers needs for refunds, which they'll want since the magazine company has cancelled the order.

Re: Magazine company refuses refunds.

At best, this is a potentially fraudulent scheme. You are placing orders, accepting money for doing so, with the intent of making it so the company who you place the orders through does not get paid. You should be happy they are only refusing the refunds and not referring you to the police or suing you civilly.

You are a scam artist. You had no right to cancel other people's magazine subscriptions. You deserve to go to jail and be sued for fraud. And now you are requesting that the lawyers here advise you on how to get away with your scheme. What chutzpah.
