Legal Question in Consumer Law in California

Painting

I purchased a limited edition print from a gallery over a month ago. they took the money out of my account the day it was purchased and a month later i had still not received it. I FINALLY got a hold of the gallery owner and he said he'd handle it. 5 days later I received the package at my home but they sent me the wrong piece. Once again i called the gallery. It took me another week to get a hold of someone. The owner said he'd handle it, just to send him an email with the information. I sent him an email but it's now been another week and i have heard nothing. I dont know how to proceed with this. They are not returning my calls or emails!

From your description it sounds like you would still like to receive the painting you paid for. I would begin with a certified, return receipt letter to the gallery owner giving him 1 week to deliver the painting and stating that non-compliance will result in you asserting you legal rights. Because a painting is a unique item not subject to replacement, time of course is of the essence. If you have any questions about this, feel free to contact me via phone or email.
