Warranty issues with laptop manufacturer

HP has not been able to diagnose or fix my laptop under warranty and it has not worked ever going back to Dec 2008. They have not pursured getting a return code with the reseller (Best Buy) and have given me the runaround and now have stopped communicating or facilitating a solution. They did not have an equivilent unit for a replacement. This issue with them is over 100 days old and I can show emails from then and may have dozens of emails sent to them detailing every step. They have acknowledged that they do not have a fix. Is there a point where this becomes some type of willful negligence? Aside from any lemon laws, is there any recourse for the trouble they have put me through? Best Buy won't replace the unit until HP gets the return code and because HP delayed any fixes, the time for a refund is long gone. What they do is pass me from rep to rep and assign different case numbers and then stop the follow up or say that can't reach someone. Best Buy told me anyone could have helped, which contradicted HP's version. Can I sue for punitive damages for the time and stress this has caused? Best Buy doesn't have a unit I want either, so I may be stuck getting what I want.

Small claims court would be the answer and would be rather quick. You can name both of them as defendants, and let them cross-complain against each other, while you obtain the benefit of their finger-pointing at each other -- and the potential judgment in your favor.
