Legal Question in Credit and Debt Law in California

Cease and Desist Letter?

Can I send a Cease and Desist letter to an attorney acting as Debt collector on behalf of the HOA that I live in. There has already been a lien filed by the attorney for $900.00. We have the HOA payments up to day and on time now. The monies that are being collected on are fees incurred by the attorney.

Re: Cease and Desist Letter?

Attorneys acting as debt collectors are subject to the fair debt collection practices act. A strong letter from an attorney who practices consumer law may be enough to make him back away.
