Legal Question in Credit and Debt Law in California

I was recently served with papers for a case management conference for an oustanding debt on an old credit card. I am aware of the debt and am unable to settle it right now. I have an elderly parent that will be released from surgery the day of the court appearance. What are my options.

You didn't say whether you ever answered the complaint. If you haven't, you should do so immediately. As for the case management conference, you might file a CMC statement with the court that includes an explanation why you can't be present. You also might call the court clerk to make a note of it, or even ask that it be continued shortly thereafter to a date you'll be available.

Assuming that you have answered the complaint - be sure that you file a Case Managment Confernce Statement. You can find these at http://www.courtinfo.ca.gov/forms/documents/cm110.pdf; Then consider calling "CourtCall" which, for a fee, may allow you to call in for purposes of the hearing and avoid missing the hearing. Or you may want to have an attorney make a special appearance for you at the hearing. There is a form that allows such appearances.
