Legal Question in Criminal Law in California
2nd offense marajuana possession
My son (minor) was just finishing his informal probation next month. That was also for possession. He went to classes, drug testing and 90 day suspension of his license. This time he was driving. He was pulled over for speeding. the cop asked to see his license but not registration or insurance. He was asked to get out and he was searched. The cop didnt find anything. He asked my son if he had anything in his car and he said yes. He gave him a ticket for possession of marajuana while driving and the back license plate light was to dim. But nothing for speeding. Contacted an attorney today says sounds like an illegal search. For them to take the case its $2500. Any suggestions??

Yes, this case could possibly be beaten on illegal search grounds unless the cop knew your son was on probation. While on probation, your son had no search and seizure rights.
$2,500 is not an outrageous retainer for such a matter. Personally, I could take it for approximately $2,000, or less if the case is resolved with a single court hearing, if your case is in Los Angeles or any of the surrounding counties.

Yes. Hire an attorney; if not that one, then someone. The quoted price is not unreasonable, about the 'going rate'. The defendant faces jail time. Feel free to contact me if interested, and if the case is in SoCal.
