Legal Question in Criminal Law in California

3 strikes-please help

my fiancee was arrested for a dui. but in 1979 he has 2 convictions for burglaries(1 his great aunt and uncles house, the other a strangers house)He pled to second degree burglary on both and went to cya on one and prison on the other.now they are trying to three strike him.can they do this?and on the one abstract of judgement i remember seeing it say something like ''this can not be used for anything else.''also he has said that other people with three strikes are being offered deals but the attorney we had says that you have to go to a romero hearing first to see if any of the strikes will be stuck.Thank you for any help

It seems very odd that a DUI is considered a strike because it is usually a misdemeanor. Is this his 4th DUI or was there great bodily injury caused by this DUI? There seems to be a lot of holes in this. Please contact my office at 310/277-1707 to further discuss your matter.
