Legal Question in Criminal Law in California

Bench Warrants

I was given a bench warrant for missing a court date, I was out on bail at the time. The next day I reinstated the bond and visited the County Clerks office. I was told my lawyer had to file a motion to pull another court calender date. It's been two weeks my lawyer has not complied. What is your advice?

Re: Bench Warrants

This is a very serious situation. You need to contact your lawyer immediately. Both of you face serious consequences if this is not adressed.

Re: Bench Warrants

Even though the bail has been reinstated, the bench warrant for your arrest still is active and if the police stop you the warrant will be enforced.

Call your attorney and if he does not get a new court date within a few days, you should immediately get another attorney.
