Legal Question in Criminal Law in California

my case

I was arrested on a warrent that was issued over two years old and never was i notified and i had been pulled over by the police before. the crime that i beening charge with is theft for person property over $400.00 witch is a felony. the case was filed in 2003 and warrent issued in 2004, we are in 2006. what are my chances of winning my case due to the fact that i was never ever notified of these charges filed against me. the arrest was a very big shock and suprise, i have a felony conviction on my record about ten years ago for grand theft which i pleaded no contest and did probation time. i am studing to be a teacher and am filing for my record to be expunged for the felony, but now this is happening. what can i expect to happen what are my chances of fighting and winning this case.

Thank You,

Very worried mother or three.

please let me know what i can do.

Re: my case

The age of the warrant won't help you at all, since warrants never expire. The fact that you had never been notified also won't help since the authorities aren't required to tell people ahead of time that they're going to be served with a warrant. A lot of people would make themselves scarce if they got such a warning.

Because you haven't told us much else about the charges or about the facts, I can't begin to tell you what to expect or what your odds will be if you end up fighting the case in court.

Good luck.
