Legal Question in Criminal Law in California

The cops found marijuana on me and my boyfriend but my boyfriend took all the blame for it so the cop issued the ticket to him. Is there any way they can drop the charges on him and I can take the blame for the possession of marijuana? He hasnt gone to court yet. It just happened today.

The suggestion that you tell the DA is possibly the worst advice I have ever read on LawGuru. That answer comes from someone who practices workers compensation law, not criminal defense.

The number one piece of advice that any decent criminal defense attorney gives any potential client is NOT TO TALK TO THE POLICE. This includes the District Attorney.

Even if you tell the DA that is was your pot, it doesn't mean your boyfriend will get off. In fact, the DA could decide to prosecute BOTH of you, because people can jointly be in possession of the same contraband.

Your boyfriend needs an attorney -- and that's who you should talk to, not the DA. If he can't afford to hire his own attorney, he should ask the judge to appoint the public defender to represent him.
