Legal Question in Criminal Law in California

My mother (83) had a checking acct with a large sum of money from a reverse mortage. My brother was on the joint account (which other siblings were not happy about)and now all the money he has over the time of 1 and half years...stolen, she has nothing left! What legal action can we go forward with the bank said it isnt consider fraud because it was a joint account. He did this reverse mortage money account for the health care of our mother and now he has taken $220.00 plus ,he legal responsibility was to use this money for her well being! Help!!!

Report him to the police and call APS, or Adult Protective Services. If he has any property, you can go after him in a civil action. At the very least, see if you can get him to pay it back.

Your family needs to immediately take legal action, that includes report the theft to police, and filing suit in an attempt to 'lock up' any money left in his possession. Feel free to contact me, one of my practice areas is elder financial abuse like this.
